TERMS & CONDITIONS (Artists)

Terms and Conditions

    • The Contract is issued as a written confirmation of a prior verbal agreement made between the Artiste, c/o Explosive Productions and the hirer and should be signed and returned promptly to Explosive Productions.  Whilst Explosive Productions and the Artiste are required to sign and return the Contract to Explosive Productions within 14 days, failure to do so is not sufficient grounds to annul the Contract.

    • This contract is subject to our terms and conditions for Explosive Productions and shall apply to all parties. These have already been notified to you and can be viewed at our web site www. explosiveproductions.co.uk

    • The Artiste’s engagement under this Contract is such that they would normally be treated as self-employed for National Insurance and Income Tax Purposes.

    • Explosive Productions will inform the Artiste of any changes in the contracted details on page 1.  Explosive Productions expect that the Artiste will do their utmost to prevent any cancellations.  All cancellations must be made in writing and agreed by the Artiste and Explosive Productions.  In the event of an agreement not being reached, the Artiste will be responsible for any payments fines or indeed any other form of compensation in full.  On cancellation there will be no monetary compensation paid to the Artiste for whatever reason.  Booking fees are not returnable on cancellation to the Artiste.

    • In the event of accident or illness preventing the Artiste from appearing, Explosive Productions is to be informed at the earliest possible opportunity and if required by Explosive Productions, the Artiste shall provide a medical certificate forthwith.

    • It is accepted that Explosive Productions act as an Employment Agent and are negotiators of this Contract but are neither an actual or implied party to the Contract between the Artiste and the function provider and cannot be held responsible in the event of non-fulfilment of any of the terms herein by either of the aforementioned parties.

    • Explosive Productions and the Artiste agree that any future bookings arising from this engagement either directly or indirectly, within 12 months of the last performance date on this Contract, shall be negotiated through Explosive Productions and a similar financial package shall apply.

    • All signatories to this Contract are advised to hold Public Liability Insurance and any relevant equipment safety documentation.

    • Failure of artiste(s) to adhere to arrival / set up times constitutes a breach of contract, and could leave them liable to claims for damages by the management.

    • Where payment is paid direct to the artiste from the hirer, that payment may be cash or cheque at the discretion of the hirer.

    • On events upon which the Artiste is unable to perform by any reason beyond the control of themselves or Explosive Productions, such as National Mourning, War, Fire, Strikes or Lock-outs directly affecting the venue, or the Order of the Licensing or any Public Authority having jurisdiction in any such event, notice will be given to both parties by each other forthwith.  On this condition Explosive Productions will pay no expenses to the Artiste.

    • For the purposes of this booking, Explosive Productions acts as an employment agency within the body of this contract.

    • This Contract is governed by the law of England and Wales and is legally binding upon all parties.

    • Corrections or objections to any of the above points 1 to 13 must be raised with the issuer immediately
